Should A State Farm Agent Make A Fault Judgement On An Accident To A Customer

my daughter had an accident and was issued a ticket, but due to the circumstances fault may be debatable at best.  However the agent based fault on the ticket, and was quite matter of fact with a person experiencing high stress.  Is it proper for an agent to make this determnation?
