• Attempt to subvert the Web Site by creating multiple accounts, writing computer programs to interfere with the scoring routines of the Web Site, encouraging other people to increase your points without merit, colluding with other users to undermine the Web Site or our scoring system, or any other activity that we conclude, in our sole discretion, as cheating our system.
• Copying and pasting the same answer repeatedly to different questions.
• Copying and pasting content directly from third-party sources.

We assume NO LIABILITY for these Requests and we strongly encourage you to use common sense when providing any information on the Web Site. If any other user Requests any of these or other things from you we strongly encourage you not to share such information.

ENFORCEMENT

We reserve the right to enforce this Agreement by any means we deem appropriate at our sole discretion. This could include, but is not limited to, account suspension or deletion, blocking access to the Web Site, cooperating with law enforcement, releasing any of your information to an entity with legal investigative jurisdiction, or by taking any other steps necessary to enforce this Agreement. We retain the right to deny access to the Web Site to any user, at any time, and for any reason, whether that reason is related to enforcement of this Agreement, or for any other reason at our sole discretion.

POINTS AND PRIZES

As part of your use of this Web Site, you have the ability to create a user account and accrue points (the “Points”) for various things. You can then utilize your points to receive prizes (the “Prizes”). You can see a current list of actions and associated point awards by visiting https://www.helpowl.com/how_it_works.php.

We reserve the right to change anything related to Points at any time. This could include, but is not limited to, changing the number of Points awarded for any actions which result in points being earned. WE RETAIN THE RIGHT TO ADJUST YOUR POINTS AT ANY TIME. Although not obligated to do so, we may attempt to make a reasonable effort to contact you in the event a change in your Points occurs. A few of the things that can occur which will result in adjustments to your Point total include, but are not limited to:

• Removal of a question you posted
• Removal of a question someone else posted for which you supplied an answer
• Removal of an answer you submitted
• Removal of a review you provided
• Your breech of this Agreement

You will not receive points for the following:

• Posting more than 3 questions in any 24 hour period
• Answering your own question
• Accepting an answer you posted
• Answering a question over 90 days old
• Rating an answer you posted
• Submitting multiple reviews for the same company, product or automobile
• Submitting manuals that are already available on the site

There are certain questions on our web site for which bonus "first accepted answer" points may not be awarded. Our system will alert you in most cases if you attempt to answer one of these questions. You will still receive points per our terms for answering the question, but the bonus points may not be awarded.

Points are not transferable

You may log in to your account at any time to see the number of points you have accrued to date. We also supply reports with more details concerning how you attained the points associated with your account. Please let us know at any time if you have a question concerning your points.

Points may be redeemed for Prizes by logging into your account. There is a minimum number of points that must be achieved before a Prize can be ordered as well as a minimum number of Points that must be redeemed for any individual redemption. To redeem your Points you select the prize you would like to receive on the point redemption screen and we will tell you how many Points are needed in order to receive that Prize. If you have enough Points to receive that Prize, there is a simple process to confirm that you would like to redeem your Points for the selected Prize. Once you complete that process, the applicable Points will be deducted from your account.

Upon your indication that you would like to receive a Prize, and that you have enough Points to qualify for that Prize, we will place an order with the respective merchant for you and the item will be emailed to the address you provide. In the event the selected Prize is not available for whatever reason, we will notify you at the email address you provided for your account and replenish your redeemed Points. We make absolutely no warranty concerning the Prize. Any issues that arise related to the Prize, including but not limited to, delivery failure, delivery delay, or inability to utilize the Prize for any reason are your responsibility. We will make a reasonable effort to assist you with any Prize or delivery-related issues, but our responsibility is limited to placing and paying for the order. Anything that occurs following the placement and payment of the order is not our responsibility.

We strongly encourage you to visit each merchant's web site to ensure that you qualify to use the associated prizes.

INDEMNITY

You agree to defend and indemnify us from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

• your breach of this Agreement;
• your violation of any law or the rights of a third party; or
• your use of this Website.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES, SHALL WE BE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE WEB SITE. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND (WHETHER GENERAL, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME OR PROFITS), WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF OUR AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE WEBSITE OR ANY CONTENT ON THE WEBSITE, OR WITH THESE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE WEBSITE. YOU ACKNOWLEDGE, BY YOUR USE OF THE WEBSITE, THAT YOUR USE IS AT YOUR SOLE RISK. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. This Agreement does not create any agency, partnership, joint venture, employment, or independent contractor relationship between the parties.
