How Can Relocation 'in General' Not Qualify For Release Of A Contract?
I received an answer that just because someone re-locates to an area that Mediacom does not service they do not consider “in general” that to be a valid reason to be released from a contract. Can someone please explain in more details why and what could be more of a valid reason than moving where the service is not offered? I cannot believe that any legitimate company can enforce a contract when the reason for an early termination is beyond the control of the person in the contract. My son and his wife have a five week old baby and have experienced two break-ins in their "supposedly safe" apartment complex in the five months they have lived there. The reason for the move is to ensure the safety of their baby before they become victims of a more violent crime. Their apartment complex understands the severity of the reason for their move (the crimes) and has released them from their lease without any penalties and that is what they are asking from Mediacom.
They do not have an issue with the service they received and would be happy to have Mediacom with them at their new address but it is not possible due to Mediacom not servicing that area. Shouldn't there be a way under a hardship issue such as theirs to be released as opposed to other customer reasons that just want to cancel? Again, they are not cancelling because they are dissatisfied; they are cancelling because Mediacom cannot fulfill THEIR PORTION of the contract. The contract both parties agreed to stated that Mediacom would provide them with Cable services and in return, they would pay for that service. In this instance Mediacom is the one that will be violating their portion of the contract because they cannot provide the contracted service since they do not service the area they are moving to. Breach of Contract is a two way street and they do not want to cause any trouble but just ask for consideration related to their hardship issue. I believe there needs to be something done for cancellations due to a person moving out of the service area to avoid continued acts of crime.
