Can I Get A Refund On My Blackberry After The Recent Problems. Handset Is Slow

purchased my bb handset less than a month ago and after the recent problems with blackberry my handset has become slow. i want to change my bb 9800 torch for a much cheaper model. is this possible? please urgently advise
