Proper Conduit For Colorlogic 4.0 Lights

I have three ColorLogic 4.0 lights in my pool. My builder used flexibile non-metalic conduit between the lights and the pool light junction boxes. The building inspector is making us change to schedule 40 PVC, and then to metal conduit where it comes out of the ground. But this will mean I have pool water inside metal conduit -which will rust. Shouldn't I use the Schedule 40 conduit all the way out of the ground, connecting to the pool light junction box? I think they are giving me a hard time because this is 110V all the way to the pool.
