Can You Buy A Locked Phone Off Of Ebay And Then Unlock It When You Get It?

I'm looking to buy a phone off of ebay and I'm haveing a hard time becuase I bought one just a little while ago and the women who sold it to me didn't tell me it had a bad esn so now I can't use it and I spent good money on buying it. virgin mobile has to expensive phones so I wanted to try to get another good one off of ebay. The seller says that the phones are locked and I want to know if it is ok for me to buy the phone and for you to tell me if it has a good esn and how or if it is even possible to unlock it before i buy it.
