If your device is currently running on jelly bean you may not get an update,

Check update settings in your device to make sure that if you are able to get an update.

Yes, you absolutly can upgrade your android system. To update to Android 4.1 Jelly Bean, you simply tap the home key and then select "Apps" at the top right corner. In "Apps," select "Settings" and then "About Device." There should be a "Software Update" option in "About Device" which should let you tap on the update option in order to get the over-the-air update for Android 4.1 Jelly Bean OS started. Simply follow the on-screen instructions to download and install the update. Please note that after the update is downloaded and installed, you will be required to restart your Galaxy tablet in order to complete the installation.

Hopefully this think help you, thank you

if your phoneis still using the jellybean system it seems like it cannot be updated. but you might also check it in your settings under device update.
